1. Parties and purpose
The Ukrainian legal entity БЛАГОДІЙНА ОРГАНІЗАЦІЯ «МІЖНАРОДНИЙ БЛАГОДІЙНИЙ ФОНД «ГОРИЗОНТ ДІЙ»», EDRPOU 46238820, at 10 Kropyvnytskoho St., Pecherskyi District, Kyiv, 01024, Ukraine, represented by the Foundation Chair Denys Yuriiovych Rodin, acting under its Charter (the Foundation), offers to enter into a donation agreement on these terms. Its official English name is INTERNATIONAL CHARITABLE FOUNDATION “ACTION HORIZON”.
A donor is a legally capable individual or private-law legal entity voluntarily making a donation. The agreement concerns a gratuitous transfer of money to the Foundation for agreed charitable purposes within its Charter and the law.
Under section 2.1 of the Charter, the Foundation provides charitable assistance: support for Ukraine’s defence capabilities and mobilisation readiness; protection of people in emergencies; support, comprehensive rehabilitation and adaptation for service personnel, combat participants, veterans, people with war-related disabilities and their families, including families of those killed, captured or missing; assistance for orphans, children without parental care or in difficult circumstances, older people and people with disabilities; and support for civilians affected by war and temporary occupation. Areas of activity and how programmes are determined are described in Foundation information.
A donation is not payment for goods or services to the donor and does not provide them with profit or a reciprocal financial benefit.
2. Acceptance
This offer is addressed to an indefinite group of donors and applies from its approved publication on horizontdiy.org until withdrawal or replacement.
The donor reads this offer and the chosen campaign’s terms before donating. The offer is accepted:
- for a bank transfer — by a voluntary transfer to the published official accounts on these terms;
- for an online payment — by ticking the box “I have read and accept the Public offer” in the form on the Foundation’s website and successfully paying the donation on the page of the WayForPay payment service to which the form redirects the donor.
The donation agreement is concluded when the Foundation receives the funds. The WayForPay receipt confirms that the service processed the payment; the Foundation verifies receipt of funds through its records. Choosing an amount, opening a form or payment page or clicking a link without payment and receipt does not confirm a donation.
The version accepted by the donor continues to govern that donation. A new version does not retrospectively change the agreed purpose of earlier funds. A separate written agreement takes precedence for matters it lawfully and expressly regulates.
3. Amount, methods and designation
The donor freely chooses the amount. The donation methods are a transfer to the Foundation’s UAH account and online card payment through the WayForPay payment service. Until online payment is enabled, the donation page shows the bank details for a transfer. Account details, payment methods, technical limits and fees are disclosed in the Payment and refund rules, on the payment page and by the payer’s bank before donating.
WayForPay provides the payment service to the donor under its public agreement for payers. The service is not a party to the donation agreement; the Foundation is the recipient of the donation.
A donation may be:
- designated for a campaign, programme or purpose identified in the agreed terms, the payment purpose or the choice made on the website for an online payment;
- for the Foundation’s general charitable activities, without designation to a particular campaign, used within its Charter under lawful decisions of its authorised body.
For a designated transfer, use the published payment purpose and campaign code; for an online payment, the designation is the campaign or area chosen on the website. If instructions conflict or do not identify the intended purpose, the Foundation seeks clarification; the contribution does not automatically become unrestricted.
4. Use of designated funds
Funds are used for their agreed purpose. A surplus, lower purchase price, incomplete campaign, cancelled need or late transfer does not automatically authorise a change of designation.
If the original purpose becomes impossible or a change is needed, the Foundation follows a lawful procedure: donor agreement, terms already validly establishing such use, or another legal basis. A website notice alone does not replace required permission. Funds are not used for a different purpose without an appropriate basis.
The Fundraising rules describe campaign operation, changes and reporting.
5. Foundation duties and donor rights
The Foundation records receipts and spending, respects designated conditions, maintains appropriate supporting documents and reports as required by law and campaign terms. Operational spending remains within the limits of law, the Charter and the agreement and is accounted for; a statutory limit is not an automatic deduction from each donation.
The Foundation publishes a report within 30 calendar days after campaign closure. If purchasing or delivery of assistance is still in progress, we publish a report on receipts, spending and progress within that period and supplement it after assistance has been delivered and supporting documents received. Information about donors and beneficiaries is published only with prior written consent; confidential military information is excluded from public reports. See the Fundraising rules.
Donors may request information about their donation and its designated use, access available reports, ask accounting questions and protect their rights as provided by law. Documents are shared with appropriate protection for others’ personal information and lawful security restrictions.
Donors or persons they authorise have the right to monitor the designated use of a donation. Donors or their successors may seek termination of the agreement if the donation is used for a purpose other than the agreed one, following the procedure provided by law.
The Foundation publishes quarterly financial reports under Reporting. This is the Foundation’s voluntary transparency standard; it does not replace mandatory reporting or statutory deadlines.
6. Incorrect payments and refunds
Under section 6.8 of the Charter, properly made donations are not returned to the donor except where the law provides otherwise. Donations do not carry the ordinary exchange or return rights of purchased goods. Rights to monitor designated use and seek termination of the agreement under the law remain available.
For an incorrect or duplicate payment, contact the Foundation. For an unauthorised transaction, contact your bank / payment provider immediately and notify the Foundation; do not wait for our reply before contacting your bank. Provide the date, amount, currency, purpose and safe transaction evidence. Do not send full card details or banking passwords.
If verification confirms a mistaken or repeated payment without an intention to make that donation, the Foundation must return the amount received without a sufficient legal basis under Article 1212 of the Civil Code of Ukraine. The Foundation likewise returns a recurring online charge made after recurring support was cancelled. Verification establishes the facts and legitimate payer; it does not make a required return discretionary. An online payment is returned through WayForPay to the same card; a bank transfer is returned to the legitimate payer through the banking channel. We do not automatically deduct a bank or payment-provider fee from the amount due for return. The review period and procedure are set out in the Payment and refund rules. Spending funds does not itself remove donor claims arising under law.
7. Recurring online support
Recurring online support is possible when the website form offers it and goes to the Foundation’s general Charter activities. It requires the donor’s separate authorisation of automatic charges (a payment mandate). Accepting this offer, a one-off donation, or consent to emails or cookies does not give such authorisation.
The authorisation is given by a separate, unticked box in the form and sets the amount, the currency (hryvnia), the frequency — daily, weekly or monthly — and that it continues until cancelled. The first contribution is paid immediately on the WayForPay payment page. WayForPay then keeps the schedule and automatically charges the same amount to the card used for the first contribution (or another card with which the donor replaced it in the WayForPay account) after each chosen period, until the support is cancelled. Each successful charge is a separate donation for the Foundation’s Charter activities on the terms of this offer.
Before each scheduled charge, WayForPay sends the payer a notice of the upcoming charge. The service may retry a failed charge after warning the payer. The Foundation sends service emails about setup and cancellation, with a personal management link, to the email address provided.
The donor may cancel recurring support at any time: with the personal link, in the WayForPay personal account or by contacting the Foundation. After cancellation, future charges stop; charges already made remain donations, and a charge made after cancellation is returned under section 6. Section 6 of the Payment and refund rules describes the cancellation procedure, notices and effects.
The Foundation does not increase the amount or change the frequency without the donor’s new authorisation. A new version of this offer does not change the terms of charges already made. If a new version changes the terms of recurring support, the Foundation notifies the donor by email, and the changed terms apply only to charges after that notice; a donor who does not agree may cancel the support at any time.
8. Personal information and separate permissions
Necessary accounting and communication information is processed under the Privacy policy. Accepting this offer does not consent to analytics, email subscriptions or publishing a name. Where available, these permissions are separate and voluntary.
Authorising recurring charges is not consent to marketing emails, cookies or publishing a name. Service emails about recurring support are not a news subscription.
9. Law, disputes and versions
Ukrainian law governs the agreement. Parties may first try to resolve an issue by contacting the Foundation; this does not restrict access to a bank, competent authority or court, or mandatory rights under other applicable laws.
The Ukrainian version is the primary version for interpreting this agreement; English conveys the same terms for convenience. Any published PDF must match the approved version. File format alone does not make a conflicting text take precedence.
